COPE, J.

The order denying postconviction relief under Florida Rule of Criminal Procedure 3.850 is reversed and the cause is remanded for a hearing.

In Monroe County Circuit Court case number 91-803, defendant-appellant Flowers pled guilty to second degree murder and received a split sentence of twelve years in prison followed by probation. He served approximately four years incarceration and by virtue of gain time (and possibly other credits) was released...
