Ordered that the judgment is modified, on the law, by (1) deleting the first and second decretal paragraphs thereof, and (2) deleting from the third decretal paragraph thereof the words "dismissing this action" and substituting therefor the word "dismissing the third, fourth, fifth, sixth, and seventh causes of action insofar as it is asserted against them...
