CHARLTON v. COM.

Record No. 2989-98-3.

526 S.E.2d 289 (2000)

32 Va. App. 47

Sherwood Antanio CHARLTON v. COMMONWEALTH of Virginia.

Court of Appeals of Virginia, Salem.

March 21, 2000.

Attorney(s) appearing for the Case

Michael T. Garrett (Pendleton, Garrett & Henderson, P.C., on brief), Amherst, for appellant.

Marla Graff Decker, Assistant Attorney General (Mark L. Earley, Attorney General, on brief), for appellee.

Present: COLEMAN and ELDER, JJ., and COLE, Senior Judge.

COLE, Senior Judge.

Sherwood Antanio Charlton, appellant, was convicted of use of a firearm in the commission of robbery. On appeal, he contends the trial court erred in denying his motion to dismiss the use of a firearm charge because he was an accessory before the fact to robbery and did not know the principals would use a firearm in the commission of the robbery. Finding no error, we affirm the conviction.
