After entering a guilty verdict on multiple RICO counts pursuant to defendant's plea agreement, the district court entered a preliminary order forfeiting a number of the defendant's assets. The defendant's wife, Yolanda Martinez ("Yolanda"), filed a claim in the ancillary proceeding claiming an interest in some of these assets on the basis of Texas community property law.
