In this common-law fraud case, Pacific Mutual Life Insurance Company ("Pacific") appeals a summary judgment granted in favor of Ernst & Young, L.L.P. ("Ernst & Young").2 In two points of error, Pacific contends the trial judge erred in granting summary judgment in favor of Ernst & Young and denying Pacific's motion for partial summary judgment.
