¶ 1. This case comes on appeal from the Circuit Court of the Second Judicial District of Tallahatchie County, Mississippi. Plaintiffs Randy Cox, Tod Logan and Philip Spinosa filed a civil action for damages against John W. Whitten, III, for assault, battery, and false imprisonment. Whitten filed a counterclaim for trespass and several other torts. He voluntarily dismissed all of the tort claims with the exception of the trespass...
