STATEMENT OF CASE

On May 6, 1998, the defendant, Kentrail Toney, was charged by bill of information with possession of a firearm by a convicted felon in violation of La. R.S. 14:95.1 and possession of heroin in violation of La. R.S. 40:966. The defendant pled not guilty to both counts at his arraignment on May 11, 1998. Motion hearings were held on May 22, 1998 and May 27, 1998. The trial court denied the defendant's motions to suppress...
