Appellee, Texas State Bank, ("the Bank") on its own behalf and on behalf of certain trust customers of the Bank, sued appellants, Frank Duperier ("Duperier"), individually, and Howard, Weil, Labouisse, Friedrichs, Inc. ("Howard Weil"), alleging Texas Securities Act ("the Act") violations and fraud. After a jury trial, the Bank elected recovery under the Act.
