Opinion by Chief Justice SEERDEN.

This is an insurance fraud case. Appellant Joseph Manning was convicted of a class "A" misdemeanor theft, and the jury assessed punishment by a fine of $1,155. See TEX.PENAL CODE ANN. § 31.03(e)(3) (Vernon Supp.2001). Manning was accused of stealing money from Farmer's Insurance Company by making a false claim under his homeowner's insurance policy...
