Before the court is "Defendant's Motion to Dismiss and Subject Thereto, Original Answer" (Dkt.# 5), filed November 18, 1999. Plaintiff's "Motion to Strike Defendant's Motion to Dismiss" (Dkt.# 7) was filed November 26, 1999.
