WALLER, Justice:

We granted a writ of certiorari to review the denial of post-conviction (PCR) relief to petitioner, Ricky Lee Allen. We reverse.

FACTS

Allen was arrested and incarcerated on June 4, 1996 for two counts of grand larceny and one count of malicious injury to property. He remained in jail for eighteen days (until June 22, 1996), at which time he was released on bond. Allen was re-arrested on separate charges1
