INTRODUCTION

Thomas E. Hamilton brought this action against his former girl friend, Sharon M. Foster requesting that the court award sole custody of Hamilton's three granddaughters to Hamilton and order Foster to pay child support. Foster demurred to Hamilton's petition for failure to state a cause of action. The district court sustained the demurrer and dismissed the action.
