Appellant, Charles Cardwell, appeals from a Court of Appeals' decision denying him relief pursuant to RCr 11.42. We affirm.

Cardwell was involved in a car crash on November 20, 1993, in which one person was killed and another person was seriously injured. Tests revealed that Cardwell's blood alcohol content was .31%.
