STRINGER, Justice.

Respondent Jean E. Scott and her husband Paul W. Scott, a Minneapolis police officer, were married in 1947. In 1979, the Scotts sold their house and separated. Both of the Scotts moved in with other people after separating, however they never divorced and continued to file joint tax returns until Paul Scott's death in August of 1995.
