THE PEOPLE OF THE STATE OF NEW YORK, Respondent, v. TAYEBE HENDERSON, Appellant.

Appellate Division of the Supreme Court of the State of New York, First Department.

Decided October 19, 2000.

Defendant's challenges to the sufficiency of the evidence are unpreserved and we decline to review them in the interest of justice. Were we to review these claims, we would find that the evidence established that the victim suffered a "physical injury" within the meaning of Penal Law § 10.00 (9) and that defendant had larcenous intent at the time of the attack.

We perceive no abuse of sentencing...
