Father and son filed suit against a bank alleging fraud, statutory fraud, breach of fiduciary duty, negligent misrepresentation, and violations of the DTPA in connection with a construction loan transaction. The jury found in favor of the father and son answering questions which support a judgment that the bank made affirmative misrepresentations regarding liability for a $60,000 loan.
