The opinion and judgment filed herein on June 17, 1999 are withdrawn, and the following opinion is issued in lieu of the earlier one.

Appellee Texas Municipal League Intergovernmental Risk Pool ("Risk Pool") sued appellants Texas Workers' Compensation Commission ("TWCC") and the Subsequent Injury Fund ("Fund") seeking a declaratory judgment that certain provisions of the Texas Workers' Compensation Act1
