OPINION

DAVIS, Judge:

¶ 1 Defendant Joey Louis Silva (Silva) appeals his conviction of communications fraud, in violation of Utah Code Ann. § 76-10-1801 (1999), and attempted escape, in violation of Utah Code Ann. § 76-8-309 (1999).

BACKGROUND
