MICHOL O'CONNOR, Justice.

The City of Houston appeals the granting of a motion for summary judgment in favor of Jeffrey K. Richard. The City claims the trial court erred because the decision of the Civil Service Commission was supported by substantial evidence and was free of any taint of illegality. We reverse and render.
