MEMORANDUM OPINION AND ORDER

This case is a putative class action involving the so-called "Y2K problem"1 in a massmarketed business software package. Plaintiff has filed this suit alleging breach of contract, express and implied warranties, fraud and negligent misrepresentation. Presently before the court is defendant's motion for summary judgment, dkt. no. 51.2
