On April 2, 1998, Defendants-Appellants James Bragg ("Bragg"), Chance Gaines ("Gaines") and Buddy Frazier ("Frazier") were charged in a sixteen-count indictment with violations of both the Clean Air Act and the Social Security Act.1 In October 1998, Bragg, Gaines and Frazier entered guilty pleas to count one of the indictment pursuant to written plea agreements in which the government agreed to drop the remaining...
