This action arises from the construction of plaintiffs' new home pursuant to a building contract entered into between the plaintiffs and defendant Irish Builders on September 16, 1991. The subject home was completed on May 1, 1992, and plaintiffs took up residence at that time. James M. Irish, Jr. (hereinafter Mr. Irish), a partner of Irish Builders, died on October 8, 1994.
