On February 5, 1999, the trial court found Ernestina Rodriguez guilty of capital murder for the death of her seventy-four day old son, Ramiro, and sentenced Ms. Rodriguez to life in prison. Rodriguez states that a motion for new trial was filed with the trial court on March 5, 1999, and subsequently denied without a hearing.
