On November 5, 1997, a federal grand jury sitting in the Central District of Illinois returned a two-count indictment charging Charlie Lawuary with possession with intent to distribute crack cocaine, in violation of 21 U.S.C. §§ 841(a)(1) and 841(b)(1)(B). On February 2, 1998, Lawuary moved to quash his arrest and suppress the evidence of his drug possession. The district court denied Lawuary's motion, finding that the arresting officer...
