SHULER, Judge:

A jury convicted Denise Gail Buckner on one count of unlawful use of the telephone. The trial court sentenced her to two years in jail suspended upon service of three months and two years probation. Buckner appeals, arguing the trial court erroneously charged the law on the crime of unlawful use of the telephone. We reverse and remand.
