David William Kimball was found guilty by a jury of the offense of Driving While Intoxicated. At trial, the prosecution's proof of all elements of the offense was uncontested with the exception of the element of intoxication. The evidence to convict him consisted of the arresting officer's testimony regarding his performance of standard sobriety tests, his own admissions, and a videotape of the traffic stop.
