David A. Combs was charged with possession with intent to distribute methamphetamine, in violation of 21 U.S.C. § 841(a)(1). The district court granted a mistrial sua sponte during Combs' first trial, when the court discovered that his attorney had possibly represented the prosecution's key witness against him. With new counsel for both Combs and the witness, a second trial commenced. A jury ultimately convicted Combs...
