LIPEZ, Circuit Judge.
William E. Freeman, Jr., an officer in the Peabody, Massachusetts, police department, was convicted by a jury on two counts of witness tampering. He was also acquitted on one count of witness tampering and one count of conspiracy to violate 18 U.S.C. § 666(a)(1)(B) (theft or bribery concerning programs receiving federal funds).
