SMITH, J.

In January, 1996, the defendant, Ricardo Robles, was indicted for unlawful possession of a firearm (third offense) and unlawful possession of ammunition. After a jury-waived trial, the defendant was found guilty of so much of the firearm indictment as charged a second offense, and guilty of possession of ammunition.

Prior to trial, the defendant filed a motion to suppress the firearm which had been seized from a vehicle in which he was a passenger...
