This matter comes before the Court on a motion for summary judgment filed by Parks Corporation ("Parks") pursuant to Fed.R.Civ.P. 56, seeking judgment in Parks' favor on the third party complaint filed by third party plaintiff Netherwood Finishing Station, Inc.
