VUKOVICH, Judge.

The state of Ohio appeals from a judgment, entered after a bench trial in the Mahoning County Common Pleas Court, that ordered that appellee Allied Industrial Development Corporation be compensated $50,000 for appropriation of its property. For the following reasons, the trial court's judgment is reversed, and this cause is remanded for a new trial before a jury.
