Appellee Richard Deloney was indicted by the Jefferson County Grand Jury on charges of possession of cocaine and possession of marijuana. The controlled substances were discovered during a "night vision search" conducted by Deloney's parole officer with the assistance of other law enforcement officers, including Louisville Police Department Detective Gayle Clemons.
