Presently before this Court is petitioner's application for a writ of habeas corpus pursuant to 28 U.S.C. § 2241. Petitioner, Hector Samuel Martinez Diaz ("petitioner" or "Diaz"), was incarcerated at Federal Correctional Institute ("F.C.I.") Fairton when he initiated this proceeding on April 18, 2000. He is presently incarcerated at F.C.I. Manchester in holdover status. Diaz contests the legality and constitutionality...
