The defendant was charged by felony complaint on November 13, 1998 with driving while intoxicated (DWI). He was arraigned on that felony complaint on December 3, 1998. Thereafter, a Broome County Grand Jury indicted him under indictment No. 99-156 on one count of driving while intoxicated as a class D felony and aggravated unlicensed operation of a motor vehicle in the first degree (AUO), a class E felony.
