No. CR 00-245.

20 S.W.3d 352 (2000)

STATE of Arkansas v. Fred SMITTIE, Jr.

Supreme Court of Arkansas.

July 7, 2000.

Attorney(s) appearing for the Case

Mark Pryor, Att'y Gen., by: Michael C. Angel, Ass't Att'y Gen., Little Rock, for appellant.

Bill Luppen, Little Rock, for appellee.

TOM GLAZE, Justice.

The State brings this appeal pursuant to Ark. R.App. P.—Crim. 3(b)-(c), and argues the trial court erred by accepting the guilty plea of appellee Fred Smittie, Jr., when the prosecuting attorney did not consent to the plea and instead requested a jury trial.
