At issue on this appeal is the refusal of the district judge, as a matter of discretion, to entertain a declaratory judgment action brought by the Hartford Fire Insurance Company against the Rhode Island Public Transit Authority ("RIPTA"). Hartford insures RIPTA under a commercial general liability policy. The pertinent background of this appeal are two different actions brought against RIPTA in state court by individuals injured by RIPTA buses...
