Plaintiff Nayda Jimenez, a former Big M employee, commenced an action in New York Supreme Court, Bronx County alleging national origin discrimination under the New York State Human Rights Law, N.Y. Exec. Law § 296 et seq. Defendant removed the case to federal court on the basis of diversity of citizenship and now moves for summary judgment pursuant to Federal Rule of Civil Procedure 56(c)....
