Defendants Richard Hyde and Bowen Construction Company appeal the trial court ruling granting Plaintiff Hill a new trial on grounds of instructional error. The appellants contend that the instruction in question did not misstate the law and could not have caused any prejudice. They contend that the court erred in granting a new trial.
