OPINION OF THE COURT

BUDD G. GOODMAN, J.

The defendant, charged in the instant indictment with criminal possession of a weapon in the third degree (Penal Law § 265.02 [4]) and criminal possession of a controlled substance in the seventh degree (Penal Law § 220.03), moves to suppress a gun, ammunition and narcotics recovered by the police on the ground that such evidence was illegally seized.
