Defendant Ramón Luciano del Rosario is charged with possession with intent to distribute seven-hundred kilograms of cocaine pursuant to 21 U.S.C. §§ 841(a)(1) (1978) and 952(a) (1984) and 18 U.S.C. § 2 (1951). Defendant moves to dismiss his indictment premised on the argument that the appointment of Mr. Guillermo Gil as interim United States Attorney of the District of Puerto Rico is unconstitutional...
