Appellant Benito Guzman was charged with capital murder for causing the death of Luis Guzman, a child under the age of six years, by striking Luis with his hand and also striking Luis with and against an unknown object. The State did not seek the death penalty, and the case went to trial on Guzman's plea of not guilty to a jury. The jury returned a verdict of guilty...
