¶ 1 Jeffrey Russell Finlayson was convicted of forcible sodomy, a first degree felony, in violation of Utah Code Ann. § 76-5-403(2) (1995); rape, a first degree felony, in violation of Utah Code Ann. § 76-5-402 (1995); and aggravated kidnaping, a first degree felony, in violation of Utah Code Ann. § 76-5-302 (1995).
