JOHNSON, Judge:

¶ 1 Charles F. Taylor, Appellant, was charged in Pittsburg County District Court, Case No. CRF-95-570, with Murder (malice aforethought) in the First Degree (Count I), and three counts of Shooting with Intent to Kill (Counts II, III, and IV). The jury found Appellant guilty on all counts and recommended life imprisonment on Counts II, III and IV and the death penalty on Count I after finding two aggravating circumstances...
