Plaintiff Nike, Inc. (Nike) initiated this action against defendant Northwestern Pacific Indemnity Company (Northwestern) for breach of an insurance contract covering losses due to employee theft. Northwestern sought summary judgment on the ground that Nike failed to initiate the action within two years of its discovery of the loss, as required by the limitation period specified in the policy.
