The issues before us arise in a lawsuit for personal injuries brought by James T. Jorgensen against three separate defendants who are no longer parties to this action. Because Jorgensen was receiving workers' compensation benefits from the Colorado Compensation Insurance Authority (CCIA) as a result of these injuries, CCIA intervened during the course of the litigation to protect its subrogation rights.
