On May 18, 2000, Magistrate Judge Robert M. Levy adhered to his previous finding, based on clear and convincing evidence, that defendant Carmine Agnello was a danger to others and to the community, but concluded that the defendant had now proposed conditions of release that afforded adequate assurance of safety.
