The Court has before it the plaintiffs-appellants/cross-appellees, Hercules Incorporated ("Hercules"), motion to dismiss the cross-appeal from Sections II, II.C and III of the Superior Court's September 30, 1998 opinion (the "cross-appeal") for lack of subject matter jurisdiction. Hercules contends that the cross-appeals must be dismissed since the Superior Court's judgment was in the appellees' favor....
