RULING ON DEFENDANT'S MOTION TO DISMISS (Doc. # 12)

ARTERTON, District Judge.

In his Motion to Dismiss (Doc. # 12), Defendant John M. Dean ("Johnny Dean") seeks dismissal of this indictment on the grounds that the institution of a federal case constitutes vindictive prosecution and requests that the Court hold an evidentiary hearing on the pending motion.
