On November 8, 1994, pursuant to a plea agreement, the appellant, Arthur James Sanford, pleaded guilty to sodomy in the first degree, a violation of § 13A-6-63, Ala.Code 1975, and to rape in the first degree, a violation of § 13A-6-61, Ala. Code 1975. On December 9, 1994, Sanford was sentenced to two concurrent 15-year terms of imprisonment, which were suspended; he was placed on five years' probation.
