The appellant, Rodrick Evans, was indicted for second-degree rape, a violation of § 13A-6-62, Ala.Code 1975. On November 17, 1994, pursuant to a negotiated agreement, he pled guilty to first-degree sexual abuse, a violation of § 13A-6-66, Ala.Code 1975, and the trial court sentenced him to serve 25 years in prison.
